EVS Broadcast Equipment (EVS BE) - Training

1. Cancellation of agreement by trainee

1. Should the trainee lose interest in the service due to EVS BE rescheduling the course, the withdrawal from the agreement is free of charge.
2. Should the agreement be cancelled between 30 and 15 days before the training course commences, 50 % of the course fees are due.
   Should the agreement be cancelled within 14 days before the training course commences or should the participant not appear, 100% of the course fees are due.
3. Cancellations have always to be noticed in writing to EVS BE. The authoritative date for the cancellation fees due is the date the written contract cancellation is received by EVS BE.

2. Cancellation of agreement by EVS Broadcast Equipment

1. EVS BE reserves the right to reschedule a class if number of participants drop below the minimum. In no event shall EVS BE be liable for any incidental, indirect, special or consequential damages, resulting from rescheduling the training.
2. EVS BE also reserves the right to cancel a course due to force majeure (especially illness, accident etc. of the trainer) or due to other circumstances beyond the control of EVS BE.
3. In such cases, the trainee will be informed as quickly as possible. Course fees already paid will be refunded in full. Further claims are excluded.

3. Obligations of EVS Broadcast Equipment

1. Holding of the training course, the provision of the course documents necessary as well as the use of premises and technical installations of EVS BE when the course is organised in EVS BE's facilities make part of EVS BE's obligations.
2. Should the course take place in the facilities of EVS BE, EVS BE will assist in booking the hotel rooms at the request of the trainees. Bookings will be made in the name and for the account of the trainee.

4. Obligations of the trainees

1. All travel expenses, insurance costs, catering (except lunch during the course) and accommodation costs of the trainees are the responsibility of and are borne by the trainees themselves.

5. Prices, conditions and terms of payment

1. The payment of the amount due for the training course has to be made on the bank account number mentioned on the confirmation document.
2. The payment has to be made at least 5 days before the start of the course.

6. Protection of data privacy

1. EVS BE undertakes to treat the data and information received with processing the training course order strictly confidentially.
   Person- and company-related data will not be passed on to third parties except otherwise authorised by express agreement of the trainee/customer.
